From the statute and from the operators' country lists

Foreign falls outside the Gambling Act’s categories, and that matters

Of the 100 operators in our material, 67 name a permit issuer. None of the issuers lies within the EEA. And eight of the country lists we read name Sweden — the operators’ own decision rather than any Swedish official one.

The statute asks something other than nationality

1 kap. 2 § of spellagen (2018:1138) settles what the Act applies to, and it does so without mentioning where a company is based:

2 § The Act shall apply to gambling provided in Sweden, unless otherwise follows from sections 3, 4 or 5. Online gambling that is not directed at the Swedish market shall not be regarded as provided in Sweden.

Two concepts carry that sentence: where the gambling is provided, and whether it is directed here. A company registered in another country that aims its online gambling at Swedish players is regarded as providing the gambling in Sweden and needs a licence. A company that aims elsewhere escapes it, however Swedish or un-Swedish its name may sound.

The word foreign therefore settles nothing on its own. What settles the matter is three other things: who the counterparty is, whether the business is directed at Sweden, and what the country list in the terms says.

Section 2 frames verification as a judgement call: documents may be requested, with no amount named. The permit ALSI-202509013-FI1 appears in the public Anjouan register under Zentari Limitada, and the coin list runs to ten entries.

Which issuers actually occur

Our material holds 100 operators, and it is built around companies that take payment in coin. The selection therefore falls short of a cross-section of all gambling online, and the figures below should be read with that in mind.

Of the 100, 67 name an issuer. Forty of the statements point to Curaçao, in four different spellings of the issuer’s name, twenty-six to Anjouan in two spellings and one to Mwali. Thirty-three operators name an issuer we could read nowhere, and that is recorded as a gap rather than as the absence of a permit.

None of the issuers belongs to the European Economic Area. That is the single most important observation in the whole sample, and it has a direct consequence for the tax question.

The tax provision asks about something other than nationality too

8 kap. 3 § of the Income Tax Act makes a win tax free where, among other cases, the gambling is provided in a state within the EEA and a Swedish licence is unnecessary for it. Note the word provided again: the point asks where the gambling is offered rather than where the licence was issued or where the company is registered.

A permit number from Curaçao therefore leaves the tax question open in either direction, and a summary saying that a foreign licence brings tax exemption is conflating two different pieces of information. The sections appear word for word, with the hundred-krona threshold and the thirty per cent, on the page about tax on winnings.

One of the two longest coin lists in the table: thirteen coins, with usdt and usdc among the six given prominence. We read the permit number ALSI-132405048-FI3 here, on the operator’s own page rather than in the Anjouan register; the company behind the brand is Cipher Games Ltd.

Eight operators name Sweden in their own terms

For 38 of the 100 the country list in the terms could be read, and eight of the 38 include Sweden.

  • PlayAmo: the same number and the same company, 217 countries.
  • Slotum: the same number and the same company, 216 countries.
  • Shuffle: Curaçao number OGL/2024/1337/0628, company Natural Nine B.V., 15 countries.
  • Crashino: permit detail missing on our side, 18 countries.

Six of the eight were read in an archived copy rather than in a direct capture, which is noted because an archived text can lag behind the current one.

Three brands, one company

Three of the eight carry the same permit number and the same company name: Novatrix SRL with ALSI-202508056-FI2. That means three signs lead to one and the same business, and that moving between two of them leaves the counterparty unchanged.

Two other rows, 7Bit Casino and Mirax, carry the same Curaçao number in our material. For one the company name is missing and for the other it is Scores55 Tech B.V. We have left the cause of the similarity uninvestigated, and we therefore draw zero conclusions from it.

The length of the list says something

Six of the lists cover between 216 and 224 countries. A list of that size is in practice a list of the world with a few exceptions, and Sweden can end up on it without anyone having made a decision about Sweden in particular.

Two lists are short. Shuffle names 15 countries, Crashino 18. A short list is a choice actually made, and Sweden appearing on a list of fifteen entries means something different from Sweden appearing on a list of two hundred and twenty.

Why any of the operators chose as it did is beyond us. We record what is written and where. The consequence usually shows first at the withdrawal, because that is when the operator checks where the customer belongs; what the terms say about that check is on the page about identity checks and withdrawals.

This is where the withdrawal cap of 100,000 USD per week in clause 9.6 comes from. We found the permit number OGL/2024/210/0198 in the Curaçao certificate register, and the company on the permit is Stack Gaming Ltd.

What the ten in the table exclude instead

For nine of the ten operators in the table the country list has been read, and Sweden is on none of them. For the tenth row, the advertising partner Vave, the information is missing, and the row is therefore marked as unread rather than as cleared.

The lists differ sharply in length. Metaspins names 58 countries, Wolf.bet 48, Wild Fortune 47, Wild.io 45, Rocketpot 34, DuckDice 16, Empire.io 12 and Rainbet 11. At Bitcasino.io the list is linked yet left out of the text we read, and the only country named expressly is Japan — one entry rather than a list, and it counts here as incomplete.

One neighbouring country does appear: DuckDice has Denmark on its list. That Sweden is absent from nine lists is moreover the operators' own statement about themselves at a particular moment. Lists change, and our reading has a date: 26 August 2026 for the terms.

Two of the lists are phrased so that they cannot be read exhaustively. Wolf.bet’s enumeration opens with “including but not limited to”, and Metaspins writes “United Kingdom (including any overseas territories)” without naming the territories. A list that calls itself incomplete fails as proof that a country is absent from it.

Which EEA countries the lists actually exclude

The 38 readable country lists can be laid on top of one another, and a pattern then emerges that every individual operator leaves unwritten.

At the top sit two countries outside the EEA: the United States on 32 of the 38 lists and the United Kingdom on 29. Then comes the Netherlands on 27 — the most frequently excluded country within the EEA by a wide margin. Spain appears on 24, France on 23, Lithuania on 19 and Belgium on 16.

Among the nine operators in the table whose list we could read, the distribution looks the same on a smaller scale. The Netherlands appears on seven of the nine lists, Spain on six, France on six, Malta on four, Lithuania on four, Germany on four and Austria on three.

A country recurring on two thirds of the lists is hardly excluded for reasons specific to any one operator. What the cause is in each individual case appears in none of the documents, and we refrain from guessing. What can be said is that anyone looking for a correlation between the lists and the legal position in each country will fail to find it in Sweden: eight operators name Sweden, while the Netherlands is named by twenty-seven.

Sweden against its neighbours in the same 38 lists

The Nordics fall out in a way that is hard to predict before counting.

  • Sweden — 8 lists of 38.
  • Iceland — 7.
  • Denmark — 2.
  • Finland — 1.
  • Norway — 0.

Norway is therefore absent altogether, even though the country has a monopoly regime and keeps a register of blocked addresses. Sweden, which leaves domains and account transfers alike unblocked and where the court-ordered block was in addition repealed in 2023, appears on the most of the five. What Swedish law actually provides is on the page about what the statute says.

The conclusion therefore falls short of saying that Swedish customers are less welcome than Norwegian ones for any legal reason. The conclusion is that a country list is a commercial decision the operator writes itself, that it tracks the strictness of regulation as little as it tracks the authorities’ instruments, and that it is nevertheless the only statement on the subject that comes from the operator in writing. Among the ten in the table, Denmark appears on one list, DuckDice’s, and Sweden on none.

The counterparty is called something other than the brand

A register number has a practical value often overlooked: the hit prints the company name. Behind Wild Fortune sits Metlait SRL, behind DuckDice Zentari Limitada, behind Rainbet RBGAMING N.V. and behind Wolf.bet Cipher Games Ltd.

That name is the counterparty to the contract, and it determines where a dispute lands. Two of the brands in the table moreover hold permits from two issuers with a different company name in each register, which is set out on the page about new casinos. Fast withdrawals are hardly a property of the word foreign

The phrase turns up often alongside this search term, and our material cannot confirm it. None of the ten sets of terms gave us a processing time in hours or days. Such a column is therefore missing from the table, and we have timed a payout nowhere ourselves.

What is written down is the cap: four operators state how much may be withdrawn and over what period, in three different currencies. A cap governs how fast the money can arrive rather than whether it arrives, and the figures appear with clause numbers on the page about identity checks and withdrawals. What the word best would need to rest on before it meant anything is dealt with on the page about the measure behind a top list.
